Data Protection Information Sheet for Customers (pursuant to Art. 13 GDPR)
Dear Business Partners,
Your data has always been safe with us. However, due to the EU-wide General Data Protection Regulation (GDPR), it is necessary to establish a formal framework for this.
This information, provided in accordance with Article 13 of the GDPR, forms an essential part of that framework. It allows you to gain a clear understanding of the key aspects of data processing within the scope of our business relationship.
The legal basis on which we process your personal data depends on the nature of our relationship:
- You have expressed interest in being contacted by us or receiving information on specific topics (Art. 6(1)(a) GDPR).
- We are fulfilling services contractually agreed with your company (Art. 6(1)(b) GDPR).
- We are providing services in preparation for a potential contract (Art. 6(1)(b) GDPR)
Additionally, in the context of our business activities, we process your data:
to fulfill legal obligations (Art. 6(1)(c) GDPR)
- e.g., financial and tax regulations
based on our legitimate interest (Art. 6(1)(f) GDPR), for purposes such as:
- Sending important news and market trend updates
- Inviting you to events and processing event registrations
- Creating statistical analyses
- Archiving
to fulfill contractual obligations (Art. 6(1)(b) GDPR), e.g.,
- Sending out security alerts
Im Rahmen unserer Prozesse lagern wir einige unserer Aktivitäten an sorgfältig ausgewählte externe Partner aus. Dadurch gelten diese Partner im Sinne der Datenschutz-Grundverordnung als Auftragsverarbeiter oder Daten-Empfänger.
As part of our operational processes, we outsource certain activities to carefully selected external partners. These partners qualify as processors or recipients of personal data within the meaning of the GDPR.

Depending on the nature of the services we provide and the hardware/software products and services used, we cooperate with various manufacturers and distributors. In this context, these distributors may receive customer data classified as personal under the GDPR, such as company names, contact persons, email addresses, and IP addresses. These entities are considered data recipients under Art. 4(9) GDPR. The manufacturers of the products you have purchased may also become sub-processors under Art. 28(4) GDPR as part of service fulfillment. In this role, they may access your personal data to the extent necessary for fulfilling the contract. A list of these manufacturers and distributors can be found here.
Providing your contact data to the minimum required extent is a prerequisite for our cooperation. If you do not agree to this, we hereby inform you — in accordance with Art. 13(3)(e) GDPR — that we may be unable to establish or continue a business relationship with your company.
We store your data only to the extent and for as long as necessary for the purposes for which it was collected. Please note that we are required under Austrian tax law to retain contracts and other related documents for a period of seven years (§ 132 BAO). In specific cases, such as pending administrative proceedings, this retention period may exceed seven years.
At any time, you have the right to:
- Request information about the personal data we process (Art. 15 GDPR)
- Request correction or deletion of your data (Art. 16 GDPR)
- Request restriction of processing (Art. 18 GDPR)
- Object to the processing of your data (Art. 21 GDPR)
- Exercise your right to data portability (Art. 20 GDPR)
You also have the right to object to the processing of your data for direct marketing purposes at any time. A short message to newsletter@bacher.at or a click on the unsubscribe link in our next newsletter is sufficient.
If you believe that our handling of your data violates data protection laws or if your rights under data protection law have been otherwise infringed, we encourage you to contact us directly (via our Data Protection Coordinator). Of course, you also have the right to lodge a complaint with the supervisory authority at any time. In Austria, this is the Data Protection Authority.
